Information on the website should not be treated as a substitute for a professional inspection, assessment, engineering advice, legal advice, or other professional advice unless expressly stated.
4. Quotes and Estimates
Any quote or estimate provided by ShieldPoint may be based on information available to us at the time and may be subject to:
- Property characteristics
- Service scope
- Site conditions
- Accessibility
- Required materials or equipment
- Additional services requested
- Conditions discovered during service
- Applicable taxes
- Other factors reasonably affecting the cost of providing the service
A quote does not automatically constitute acceptance of a service contract unless expressly stated.
5. Booking and Appointments
Appointments are subject to availability.
Customers are responsible for providing accurate contact information, property address, appointment details, access instructions, and relevant property information.
ShieldPoint may need to reschedule an appointment because of weather, safety conditions, access problems, emergencies, staffing issues, equipment issues, or other circumstances outside our reasonable control.
We will make reasonable efforts to notify customers of material scheduling changes.
6. Home Inspection Services
Home inspection services are performed within the scope agreed upon with the customer and subject to applicable Ontario requirements.
A home inspection is generally a visual and non-invasive evaluation of applicable components and conditions of a property within the agreed inspection scope.
A home inspection is not a guarantee that a property is free from defects, deficiencies, damage, or future problems.
Where required by applicable Ontario law, a written home inspection agreement will be provided and will govern the inspection services.
7. Limitations of Home Inspections
Unless expressly included in the agreed scope, a home inspection may not include:
- Destructive testing
- Opening walls, ceilings, floors, or finished surfaces
- Moving permanently installed or heavy items
- Dismantling equipment
- Excavation
- Destructive investigation
- Laboratory testing
- Environmental testing
- Specialized engineering analysis
- Structural engineering certification
- Mold testing
- Asbestos testing
- Lead testing
- Radon testing
- Water quality testing
- Sewer scope inspection
- Specialized pest or termite inspection
- Specialized electrical, plumbing, HVAC, roofing, or structural engineering analysis beyond the agreed inspection scope
ShieldPoint may recommend additional assessment by an appropriately qualified specialist where conditions appear to require expertise or testing outside the inspection scope.
8. Hidden or Inaccessible Conditions
Some defects or conditions may not be visible or reasonably discoverable during a visual and non-invasive inspection.
Examples may include:
- Concealed defects
- Defects behind finished surfaces
- Intermittent conditions
- Weather-related conditions
- Inaccessible areas
- Conditions that arise after the inspection
- Latent structural issues
- Concealed moisture
- Hidden plumbing or electrical issues
- Conditions caused by subsequent alterations or repairs
The absence of a comment in an inspection report does not necessarily mean that a component or condition is defect-free.
9. Home Inspection Reports
Where a report is provided, it reflects observations made at the time of inspection and within the agreed scope.
Customers should review the report in its entirety, including observations, limitations, exclusions, qualifications, and recommendations.
The report should not be interpreted as a prediction of future property conditions or future performance of components.
10. Customer Responsibilities for Home Inspections
Customers are responsible for:
- Providing reasonable access to the property
- Disclosing known concerns or relevant information
- Ensuring utilities and systems intended to be inspected are safely accessible and operational where appropriate
- Removing personal belongings or obstacles where necessary
- Ensuring pets are safely secured
- Informing ShieldPoint about known hazards
ShieldPoint may decline to inspect an area where access or inspection would create an unreasonable safety risk.
11. Pest Control Services
Pest control services are provided according to the agreed treatment plan, service description, and applicable laws and regulations.
Results may vary depending on:
- Type of pest
- Severity of infestation
- Property condition
- Access to affected areas
- Sanitation
- Moisture
- Structural conditions
- Customer compliance with preparation instructions
- Weather and environmental conditions
- Re-entry or treatment restrictions
- Behaviour and biology of the pest
Pest control services do not guarantee that pests will never return.
12. Customer Responsibilities for Pest Control
Customers must follow all reasonable preparation, treatment, safety, and post-treatment instructions provided by ShieldPoint.
Depending on the service, customers may be required to:
- Remove or cover food
- Secure pets
- Vacate treated areas
- Remove or protect sensitive items
- Repair conditions contributing to infestation

Failure to follow required instructions may reduce treatment effectiveness and may require additional services.
13. Pesticide Use and Licensing
Where pest control services involve pesticides, ShieldPoint will comply with applicable Ontario requirements.
Customers must follow all product-specific safety instructions and re-entry instructions provided by ShieldPoint in connection with a treatment.
14. Treatment Results and Follow-Up
Certain pest problems may require multiple treatments or follow-up visits.
Unless expressly stated in writing, ShieldPoint does not guarantee complete elimination of pests after a single treatment.
Any warranty, guarantee, follow-up treatment, or service commitment will be governed by the specific written service agreement or service documentation provided to the customer.
15. Safety
ShieldPoint may refuse or postpone work where conditions create an unreasonable risk to customers, employees, contractors, occupants, pets, property, or the environment.
Customers must disclose known hazards, including dangerous animals, unsafe structures, chemical hazards, or other conditions that may affect service safety.
16. Payment
Unless otherwise agreed in writing, payment is due according to the applicable invoice, quotation, booking confirmation, or service agreement.
- Applicable taxes are payable in addition to the quoted price unless expressly stated otherwise.
- Additional services requested by the customer may result in additional charges.
- Payment methods may be subject to availability and the applicable service agreement.
- Any disclosed cancellation or missed-appointment charges will be subject to applicable law.
Nothing in these Terms is intended to override mandatory consumer protection requirements.
17. Cancellation and Rescheduling
Cancellation and rescheduling terms may vary depending on the service booked and the applicable service agreement.
Customers should contact ShieldPoint as soon as possible if they need to cancel or reschedule an appointment.
Nothing in these Terms removes or restricts cancellation rights or other consumer rights that cannot legally be excluded under applicable Ontario or Canadian law.
18. Consumer Protection Rights
Nothing in these Terms is intended to waive, exclude, or restrict any statutory consumer rights that apply to a customer.
Where applicable legislation provides rights or remedies that conflict with these Terms, the applicable legislation will prevail.

21. Reviews and Customer Feedback
If you voluntarily provide a review, testimonial, photograph, comment, or other feedback to ShieldPoint, we may use that material for legitimate business and marketing purposes where permitted by law and subject to any consent or agreement applicable to the submission.
ShieldPoint will not knowingly misrepresent a customer’s experience.
22. Service Limitations
ShieldPoint will provide services in accordance with the applicable agreement and applicable professional, regulatory, and legal requirements.
However, certain outcomes cannot reasonably be guaranteed.
- A home inspection cannot guarantee that a property has no hidden or future defects.
- A pest treatment cannot guarantee that pests will never return.
- An inspection report cannot predict future deterioration or future events.
- A treatment cannot eliminate conditions outside ShieldPoint’s reasonable control.
23. Limitation of Liability
To the maximum extent permitted by applicable law, ShieldPoint will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services, except where such limitation is prohibited by law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Any limitation of liability applicable to a specific paid service will be governed by the applicable written service agreement and applicable law.
24. Indemnification
To the extent permitted by law, you agree to indemnify and hold ShieldPoint, its owners, employees, contractors, and authorized service providers harmless from claims, losses, liabilities, or expenses arising from:
- Your unlawful use of the website
- Your violation of these Terms
- Your provision of materially false or misleading information
- Your failure to follow reasonable service instructions
- Your intentional or negligent misuse of our services
This provision does not apply to the extent that such indemnification would be prohibited by applicable law.

ShieldPoint may update these Terms from time to time to reflect changes in our services, business practices, technology, or legal requirements.
Updated Terms will be posted on our website with a revised “Last Updated” date.

Any dispute will be subject to the jurisdiction of the courts or other legally applicable dispute-resolution mechanisms in Ontario, subject to any mandatory rights or protections provided by applicable law.
